A DPA is a legally binding contract required under GDPR Article 28 between a data controller (the merchant) and a data processor (AI SmartTalk). It defines what personal data is processed, for what purposes, how long it is retained, what security measures are in place, and the obligations of each party.
Under the GDPR, having a signed DPA is mandatory whenever you use a third-party service that processes personal data on your behalf. We recommend downloading our DPA, signing it, and sending it to contact+privacy@aismartalk.com to ensure full compliance.
AI SmartTalk processes only the data strictly necessary for the chatbot service: first name, last name, email address, conversation content, and internal platform identifiers. Order data (if requested by the user) is retrieved in real-time from your platform but is never stored by AI SmartTalk. Data is not shared with third parties and is not used for AI model training.
All data is hosted exclusively in France, within the European Union. AI SmartTalk does not transfer data outside the EEA. You can also choose sovereign AI models hosted in France for maximum data sovereignty.
Conversation transcripts are retained for a maximum of 13 months from the last interaction. Data can be deleted earlier at the request of the merchant or the end user. At the end of the contract, all data is deleted or returned according to your preference.
The DPA includes an Annex A with a ready-to-use clause that you can integrate into your website's Privacy Policy. This clause informs your users about the use of AI SmartTalk as a data processor and explains how their data is handled.
AI SmartTalk is designed to meet the requirements of the EU AI Act, including transparency, risk management, and human oversight. Our flexible hosting and model selection options allow you to choose the level of sovereignty that matches your regulatory needs.
End users have full GDPR rights: access, rectification, erasure, restriction, portability, and objection. As the data controller, you handle these requests. If needed, forward them to AI SmartTalk, which commits to responding within 30 business days.
